The Commission has received information that individuals or group of persons representing DV BOER FARM CORPORATION(DV Boer)are enticing the public to invest in the said entity onlineand through walk-in solicitations. Based on the information communicatedand gatheredbythe Commission, DV Boeris engaged in soliciting investmentswhere an investormay invest inthe following “Pa-iwiPrograms”:Goat Dairy Pa-iwi Programa.A 36-month Pa-iwib.Costs Php160,000.00. c.15 heads of goats shallbe purchased for the investord.With the followingpayouts: i.12thmonth for Php22,500ii.20thmonth for Php45,000iii.28thmonth for Php45,000iv.36thmonth for Php45,000 v.Thereafter, a salvage value of Php75,000e.A total of 15% interest per annum.Goat Meat Pa-IwiProgram a.A 35-monthPa-iwib.Costs Php160,000c.15 heads of goatsshall be purchasedfor the investord.The payouts will be received on the following:i.11thmonth for Php22,500ii.19thmonth for Php45,000iii.27thmonth for Php45,000iv.35thmonth for Php45,000v.Thereafter, a salvage value of Php75,000e.A total of 15% interestper annum.Chicken Breeding Program a.A 18-Month Pa-iwib.Costs Php100,000 c.100 heads of chickenshall be purchased for the investord.The payout will be receivedat the18thmonth in the amount of Php20,000 and thereafter, a salvage value of Php100,000. e.A total of 20% interestper annum.Cattle Affinuer Programa.A 1-year Pa-iwib.CostsPhp1,000,000 c.40 head of cows shall be purchasedfor the investord.The payouts will be received on the 13thmonth in the amount of Php150,000.e.A return of 15% per annum.
Dairy Cattle Breeding Pa-iwiProgram a.A 3-year pa-iwib.Costs Php2,060,000. c.5 heads of the cows shall be purchasedfor the investord.With the followingpayouts:i.12thmonth for Php600,000ii.24thmonth for Php600,000iii.36thmonth for Php600,000iv.Thereafter, a salvage value of the Php2,000,000e.A return of 30% per annumRabbit Pa-iwiProgram a.A 1-year pa-iwiprogram. b.Cost Php10,000.00. c.3 heads of rabbits shall be purchasedfor the investor. d.The payout shall be received at the end of the 1-year period in the amount of Php900. e.Thereafter, the salvage value of Php10,000 is also returned by DV Boer to the investor.f.A return of 9% per annum.Allegedly, the money investedwillbe used to fund thecompany’sdiverse businesses “Pa-iwi Programs” carried out by DV Boer or its sub farms.The public is hereby informed that DV BOER FARM CORPORATIONisregistered with the Commission ONLY as a corporationunder the Corporation Code ofthe PhilippinesbutisNOTauthorizedto offer, solicit, sell or distribute anyinvestment/securities. Such activities require a Secondary License from the Commission and the securities or investment product should likewise be registered with SEC before they can be offered or sold to the publicunder Sections 8 and 12 of the Securities Regulation Code (SRC). Consequently, those who act as salesmen, brokers, dealers or agents of DV BOER FARM CORPORATIONin selling or convincing people to invest in the investment scheme including solicitations or recruitment through the internet may likewise be prosecuted and held criminally liable under Section 28 of the Securities Regulation Code and penalized with a maximum fine of Five Million pesos (P5,000,000.00) or penalty of Twenty One (21) years imprisonment or both pursuant to Section 73 of the SRC. Accordingly, those who invite or recruit other people to join or invest in this venture or offer contracts or securities to the public may be held liable or accordingly sanctioned or penalized in accordance with the Supreme Court decision in the case of SEC vs. Oudine Santos (G.R. No. 195542, March 19, 2014).
